Copyright and DMCA Policy
Last updated: July 1, 2026
1. Our commitment to intellectual property
Zod respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512), the Copyright Act, and other applicable intellectual property laws, we have adopted a policy to address claims of copyright infringement.
It is our policy to:
- Promptly respond to valid notices of alleged copyright infringement
- Remove or disable access to infringing material
- Terminate the accounts of repeat infringers in appropriate circumstances
- Comply with all applicable safe harbor provisions under the DMCA
2. Filing a DMCA notice
If you believe in good faith that material available on or through the Service infringes your copyright, you (or your authorized agent) may submit a written notice of claimed infringement ("DMCA Notice") to our Designated Copyright Agent.
To be effective, your DMCA Notice must include substantially the following:
- Your signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work — Identify the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works
- Identification of infringing material — Identify the material that is claimed to be infringing (or the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (including the URL, page, or location on the Service)
- Your contact information — Your name, address, telephone number, and email address
- Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- Accuracy statement — A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages and attorneys' fees. Please ensure your notice is accurate and submitted in good faith.
3. Designated Copyright Agent
All DMCA notices and counter-notices should be sent to our Designated Copyright Agent:
Designated Copyright Agent: Zod, Inc. Copyright Agent
Physical mail: Zod, Inc., 548 Market Street, PMB 72296, San Francisco, CA 94104-5401, United States
Email: contact@zodagent.com
Subject line: "DMCA Notice — [Your Company Name]"
You are encouraged to send notices by email for fastest processing. We will acknowledge receipt and respond within 3 business days.
4. Counter-notice procedure
If your material was removed or disabled as a result of a DMCA notice and you believe the material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice. To be effective, your counter-notice must include substantially the following:
- Your signature — Your physical or electronic signature
- Identification of removed material — Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
- Good faith statement — A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Consent to jurisdiction — Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, the federal district court for the Northern District of California), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person
Upon receipt of a valid counter-notice, we will forward it to the original complaining party and inform them that the removed material will be restored in 10-14 business days unless the complaining party files a court action seeking to restrain the allegedly infringing activity. If no such action is filed, we will restore the material.
5. Repeat infringer policy
It is our policy to terminate, in appropriate circumstances and at our discretion, the accounts of users who are repeat infringers of intellectual property rights. A "repeat infringer" is typically a user who has been the subject of more than two valid DMCA notices or who has otherwise demonstrated a pattern of infringement.
We also reserve the right to:
- Track valid DMCA notices against user accounts
- Disable accounts at any time for egregious or single-instance infringement
- Report suspected criminal infringement to appropriate authorities
6. AI-generated content and copyright
Zod's Service includes AI-powered features that generate code, text, and other content. Copyright law as it applies to AI-generated content is evolving and may vary by jurisdiction. We note the following:
- The output of AI models may be similar or identical to existing copyrighted works. You are responsible for ensuring your use of AI-generated outputs does not infringe third-party rights.
- If you believe that AI-generated output from the Zod Service infringes your copyright, you may submit a DMCA notice as described above. Please identify the specific output and provide sufficient detail to allow us to investigate.
- Zod does not claim ownership of AI-generated outputs created by users. Ownership is governed by our Terms of Service.
- We take reasonable steps to design our systems to avoid reproducing verbatim copyrighted content, but we cannot guarantee that AI outputs will never resemble copyrighted material.
7. Trademark claims
The DMCA process is specific to copyright claims. If you believe that material on the Service infringes your trademark, please submit a written notice to contact@zodagent.com with the subject "Trademark Claim" and include:
- A description of the trademark and registration number (if registered)
- The jurisdiction(s) in which the trademark is protected
- The specific location (URL) of the allegedly infringing use
- Your contact information
- A statement of your good faith belief that the use is not authorized
We will investigate and respond to trademark claims within 10 business days.
